The Legal Contexts of Care


How does the law affect social care?  In this module you’ll learn how to identify legal dilemmas in social care, and look at specific laws, such as the Children’s Act, and how the law applies to mental health issues.  You’ll also develop critical thinking skills to allow you to fully appreciate the complexity of the situations facing care workers, their managers, and all those who work with vulnerable people.

What does the module cover?

Develop an awareness of the legal system in Britain, including legislation, courts and the roles of those working in them.  Learn to appreciate some of the principles of the law when working with children, young people, families, mental health, people with disabilities and older people.  You’ll also explore the types of scenarios where social care professionals might put the law into practice.

Assessment


You’ll need to successfully produce a piece of written work (3000-3,500 words) requiring short answers to a series of questions based on case study scenarios including:  children and young people; community care; mental health protection; and issues of conflict/violence.  Answers must demonstrate an understanding of the legal context of care, the potential and limitations of the role of those employed in social care, and understandings of the debates regarding the potential for empowerment of care service users.
